Terms of Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purpose of learning about and requesting our services. You agree not to:

• Use the Site in any way that violates applicable law or these Terms, or that infringes the rights of others
• Copy, reproduce, scrape, harvest, data-mine, or systematically extract content or data from the Site, or use automated tools, bots, or crawlers except for legitimate search-engine indexing
• Attempt to gain unauthorized access to, interfere with, disrupt, or overload the Site, its servers, or networks (including introducing malware or launching denial-of-service activity)
• Reverse engineer, decompile, or attempt to derive source code from the Site, or circumvent any security or access controls
• Submit false, misleading, or fraudulent information, or impersonate any person or entity
• Use the Site to transmit unsolicited advertising or to collect information about other users

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

The Site is an informational and lead-generation tool. Submitting a contact or service-request form, requesting a quote, or otherwise contacting us through the Site does not create a contract for services and does not obligate either of us until we and you enter into a separate written agreement. Online booking is not available through the Site.

Any pricing, estimate, quote, availability, or timeframe presented on or through the Site is for general informational purposes, is non-binding, and is subject to on-site inspection, measurement, equipment and parts availability, site conditions, and a final written estimate or proposal. Descriptions of services, equipment, manufacturers, warranties, and promotions are provided for convenience and may change without notice.

Home-improvement and HVAC installation and service work is performed only under a separate written contract between you and Enviro Heating & Air Conditioning, which governs the scope, price, payment, warranties, change orders, and cancellation rights for that work and which controls over the Site in the event of any conflict. Such contracts are governed by California law applicable to home-improvement contracts and licensed contractors (including CSLB requirements). Nothing on the Site modifies or waives any right you have under that written contract or under California law.

By providing your contact information and submitting a form, you agree that we may contact you about your inquiry using the contact information you provide. Our contact forms let you choose to be reached by phone or email, and we will use the method you select to respond to and follow up on your request. Consent to be contacted is not a condition of any purchase.

No automated or marketing text messages. Enviro Heating & Air Conditioning does not operate an automated or marketing text-messaging (SMS) program and does not collect mobile numbers on this Site for recurring or promotional texts. If we exchange a text with you directly while handling your specific request, that is an individual, person-to-person message, not an automated program, and standard message and data rates from your carrier may apply to any message you choose to send. See Section 6 of our Privacy Policy for details.

Call monitoring and recording. Calls to or from our office may be monitored or recorded for quality assurance, training, and follow-up. Because California is an all-party consent state, where a call is recorded we provide notice at the start of the call, and continuing the call after that notice indicates your consent. See Section 7 of our Privacy Policy.

Informal resolution first. We want to resolve any concern quickly and without the cost of formal proceedings. Before starting an arbitration or other claim, please contact us using Section 15 and give us 30 days to try to resolve the matter informally. Many disputes can be resolved this way.

Binding arbitration. If we cannot resolve a dispute informally, you and Enviro Heating & Air Conditioning Inc agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by final and binding arbitration, rather than in court, except as stated below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, will be governed by the Federal Arbitration Act and the laws of the State of California, and will take place in or be administered from Sonoma County, California (or by phone, video, or document submission where the rules allow). The arbitrator's award may be entered in any court of competent jurisdiction. The AAA's rules and fee schedules are available at adr.org.

Class-action waiver. You and Enviro Heating & Air Conditioning agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Your right to opt out (30 days). Arbitration and the class-action waiver are not mandatory. You may opt out by sending written notice within 30 days of first accepting these Terms to Enviro Heating & Air Conditioning Inc using the mailing address or email in Section 15, stating your name and that you wish to opt out of the arbitration provision. If you opt out, disputes will be resolved in the courts identified in Section 11, and opting out will not affect any other part of these Terms.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property or to stop unauthorized access to or misuse of the Site. This Section governs disputes about the Site and these Terms; any dispute about HVAC or home-improvement work is governed by the separate written contract for that work (Section 4) and by the California consumer and home-improvement laws that apply to it. Nothing in this Section waives any right or remedy that cannot be waived under applicable law, and if the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration.

Parts of this Site may be created or supported with artificial-intelligence (AI) tools — for example, to help draft or organize informational content and to power interactive features such as estimators, calculators, scorecards, and other planning tools. We provide these for general information and convenience.

AI-assisted content and tool outputs are illustrative and may be incomplete or inaccurate. They are not professional, engineering, or HVAC advice, and they are not a diagnosis, a guarantee, or an offer. Any figure, range, recommendation, or result a tool produces is an estimate only and is non-binding until confirmed in a separate signed written agreement following an on-site evaluation (Section 4). A real Enviro Heating & Air Conditioning team member reviews content and incoming requests, but we do not warrant that AI-assisted output is error-free, current, or suitable for your specific situation, and you should not rely on it as your sole basis for a decision.

Please confirm any important detail with us directly before acting on it. To the fullest extent permitted by law, the disclaimers in Section 8 and the limitation of liability in Section 9 apply to AI-assisted content and tools.
